El Salvador redefine seu sistema penal com a aprovação da Prisão Perpétua

Uma reforma constitucional que endurece as punições e reconfigura o debate regional sobre justiça, segurança e direitos.

El Salvador deu uma guinada estrutural em seu modelo de justiça criminal após aprovar uma reforma constitucional que permite a prisão perpétua para crimes de extrema gravidade. A iniciativa, liderada pelo presidente Nayib Bukele, marca um ponto de inflexão na política criminal do país e projeta seus efeitos além de suas fronteiras.

A reforma foi aprovada por maioria qualificada na Assembleia Legislativa, consolidando o apoio político de um governo que fez da segurança sua principal prioridade. A mudança permite a aplicação de penas de prisão perpétua em casos de homicídio qualificado, terrorismo, crime organizado e delitos altamente violentos.

O contexto é decisivo. Em 2015, El Salvador registrava uma taxa de homicídios próxima de 103 por 100 mil habitantes, uma das mais altas do mundo. Em 2025, esse número caiu drasticamente para menos de 3 por 100 mil, segundo dados oficiais, em grande parte devido ao estado de exceção e às políticas rigorosas contra gangues.

Desde 2022, mais de 75 mil pessoas foram detidas em operações massivas contra organizações criminosas. Paralelamente, o país investiu fortemente em infraestrutura prisional, com destaque para o Centro de Confinamento do Terrorismo (CECOT), um dos maiores complexos carcerários da América Latina, com capacidade para mais de 40 mil detentos.

A introdução da prisão perpétua reforça essa estratégia. Para o governo, trata-se de um mecanismo definitivo de dissuasão contra crimes que não devem admitir reintegração. A medida envia uma mensagem clara: determinados delitos não terão possibilidade de retorno à sociedade.

No entanto, a reforma também gerou debate. Organizações internacionais e especialistas em direitos humanos alertam para os riscos de consolidar um sistema excessivamente punitivo, especialmente em um contexto onde o devido processo tem sido questionado. O debate gira em torno de um dilema clássico: segurança versus direitos individuais.

No plano regional, a decisão de El Salvador reabre uma discussão mais ampla sobre o uso de penas extremas na América Latina. Enquanto alguns países aboliram ou limitaram a prisão perpétua, outros observam o modelo salvadorenho como possível referência em cenários de alta criminalidade.

Mais do que uma controvérsia, El Salvador está redefinindo sua estrutura legal em um ritmo incomum. A prisão perpétua não é apenas uma ferramenta jurídica, mas o reflexo de uma transformação profunda na forma como o Estado entende punição, prevenção e controle do crime.

O impacto de longo prazo dessa reforma ainda será avaliado. Por ora, o país se posiciona no centro de um debate global sobre justiça, poder e os limites do sistema penal em sociedades marcadas pela violência.
